Why Escondido clients call Green Law Group

You work directly with our attorneys. Steven D. Green leads our cases, and his time in operating rooms before law school helps him read the medical records that drive an injury claim. We work with Escondido clients by phone and video, and the case review is free.

Before he became a lawyer, Steven was a manager for several medical device companies and trained surgeons in the operating room on spinal fusion, disc replacement and cardiac laser systems. When an insurer says your back surgery was unrelated to the crash, he can read the imaging and surgical notes himself. He earned his law degree cum laude from Loyola University Chicago School of Law, with a Health Law certificate.

Our senior litigation paralegal, Jennifer Kearney, spent 15+ years at civil defense and plaintiff firms throughout San Diego County and knows the California Tort Claims Act. That matters in Escondido, where an injury can involve a city street, a transit vehicle or a district hospital.

We work on contingency. No fee unless we win, and no costs if we don't. Your written fee agreement must state that the fee is not set by law and is negotiable Bus. & Prof. Code 6147, and we walk you through it before you sign.

Crashes on Escondido roads and freeways

Escondido sits where I-15 meets SR-78, so many of our Escondido cases start with a freeway crash or a collision on a busy city arterial. The steps after a crash are the same everywhere in California. Our California car accident page covers the full claim process.

  • I-15 carries North County commuters south toward Rancho Bernardo and San Diego and north toward Riverside County.
  • SR-78 runs west toward San Marcos, Vista and Oceanside. The SPRINTER rail line follows the same corridor.
  • City streets such as Centre City Parkway, Valley Parkway and Citracado Parkway mix commuters, transit buses, cyclists and people walking to shops, schools and the hospital.

If anyone was hurt, you must report the crash to the DMV within 10 days on form SR-1 Veh. Code 16000. California uses pure comparative fault, so a share of blame lowers your recovery but does not erase it Li v. Yellow Cab Co. (1975) 13 Cal.3d 804. Riders and cyclists can read more on our motorcycle accident and bicycle accident pages. For a rough number, try our car accident settlement calculator.

Getting your Escondido crash report

The agency depends on where the crash happened. Escondido Police handle city streets inside Escondido. The California Highway Patrol's Oceanside Area office covers I-15, SR-78 and unincorporated county roads such as those around Valley Center. Your incident card or exchange slip should name the agency and the report number.

Reports take time to finish, so call the agency before you go in person. Parties to the crash, such as drivers and injured passengers, can usually get a copy. Once you hire us, we request the report, photos and witness information for you.

Claims against the City, NCTD, Caltrans or a public hospital

Public entities get a much shorter deadline. You usually must file a written claim within six months of the injury before you can sue Gov. Code 911.2. In Escondido that rule reaches the City, NCTD's SPRINTER and BREEZE, MTS buses, Caltrans and the public authority that runs Palomar Medical Center Escondido.

Who counts as a public entity in Escondido

  • City of Escondido. City vehicles, sidewalks, signals and parks. The City's claim form goes to the City Clerk, 201 North Broadway, Escondido, CA 92025.
  • North County Transit District (NCTD). The SPRINTER hybrid rail runs 22 miles between Oceanside and Escondido. NCTD's Escondido Transit Center at 796 W. Valley Parkway is the SPRINTER's eastern end and a hub for BREEZE buses.
  • MTS. MTS routes 235 and 280 also stop at the Escondido Transit Center.
  • Caltrans. Its District 11 maintains state highways in San Diego County, including I-15 and SR-78. Dangerous-condition claims against the State go through the State's Government Claims Program.
  • Palomar Medical Center Escondido. Since July 1, 2026, the hospital at 2185 W. Citracado Parkway has been run by Palomar UC San Diego Health, a joint powers authority formed by Palomar Health, a public healthcare district, and UC San Diego Health. California counts districts and public authorities as public entities Gov. Code 811.2. The date of your treatment can change which entity a claim must name, so we check that for you.

The six-month claim covers injuries, wrongful death and damage to personal property such as your car. If the entity rejects the claim in writing, you generally have six months from that notice to sue Gov. Code 945.6. If you miss the six months, you can ask for permission to file a late claim, but the request must be made within one year of the injury Gov. Code 911.4. The entity must grant it in some cases, such as when the injured person was a child during the claim period Gov. Code 911.6. The usual pause for children does not extend a lawsuit against a public entity CCP 352.

If you think care at a district hospital went wrong, the government claim is only one of the deadlines. Malpractice cases carry their own time limits CCP 340.5. Steven's operating-room background helps him read surgical and hospital records. See our medical malpractice page.

What to do in the first days after an Escondido injury

Get medical care first, then protect the evidence. Write down the report number and the agency, photograph the scene and your injuries, and keep every bill. If a bus, train, city vehicle or hospital was involved, call a lawyer within days, because the six-month claim clock is already running.

  1. See a doctor. Some injuries, including concussions and disc injuries, show up hours or days later. Follow through on referrals and therapy.
  2. Note the details. Write down the SPRINTER car, BREEZE route or bus number, the time and the stop if transit was involved. Transit and business video can be overwritten.
  3. File your SR-1 with the DMV within 10 days if anyone was hurt.
  4. Be careful with insurers. You do not have to give the other driver's insurer a recorded statement. Send them to us.
  5. Keep a simple diary of pain, missed work and activities you cannot do. It helps prove your damages later.

Where an Escondido injury case is filed

If your case goes to court, it is filed in San Diego Superior Court. The court's ZIP code list assigns Escondido ZIP codes 92025, 92026, 92027 and 92029 to the North County Division, so the case would usually be heard at the North County Regional Center in Vista. Most cases still settle.

The North County Regional Center is at 325 South Melrose Drive, Vista, CA 92081, and hears civil cases along with criminal, family and other matters. The court assigns a civil case using the ZIP code or city where the person or company being sued lives or does business, or where the incident happened. A suit against a defendant based in central San Diego can end up at the Hall of Justice downtown instead.

You will not need to appear for most steps. We handle the filings, and many cases resolve through mediation. If you need to give a deposition or testify, we prepare you and go with you.

Questions

Escondido personal injury FAQ

How do I get my Escondido police report?

If Escondido Police handled the crash, request the report from the department's Records Division at 1163 North Centre City Parkway, Escondido, CA 92026, or through its online records request portal. Records is open Monday through Friday, 8 a.m. to 5 p.m., at 760-839-4722. If the crash was on I-15, SR-78 or an unincorporated road, ask the CHP Oceanside Area office in Vista instead.

Where would my Escondido injury lawsuit be filed?

San Diego Superior Court assigns civil cases by the ZIP code or city where the defendant lives or does business, or where the incident happened. Escondido ZIP codes 92025, 92026, 92027 and 92029 are on the North County list, so the case would usually go to the North County Regional Center at 325 South Melrose Drive in Vista. Most injury claims settle before trial.

What if I was hurt on the SPRINTER or a BREEZE bus in Escondido?

The SPRINTER and BREEZE are run by the North County Transit District, a public agency. Before you can sue, you usually must file a written government claim within six months of the injury (Government Code section 911.2). The same rule applies to passengers, drivers, cyclists and pedestrians. Call early so onboard and station video can be requested before it is lost.

Can I bring a claim against Palomar Medical Center Escondido?

Yes, but public-entity rules apply. Since July 1, 2026, the hospital has been run by Palomar UC San Diego Health, a joint powers authority formed by Palomar Health, a public healthcare district, and UC San Diego Health. Both are public entities under California law, so an injury claim usually needs a written government claim within six months. Medical malpractice claims also have their own notice rules and deadlines. Talk to a lawyer quickly if you think a hospital error hurt you.

How long do I have to file an injury claim in Escondido?

Most California injury lawsuits must be filed within two years of the injury (Code of Civil Procedure section 335.1). Claims against the City of Escondido, NCTD, MTS, Caltrans, the authority that runs Palomar Medical Center or another public entity usually need a written claim within six months (Government Code section 911.2). That deadline applies to children too, though a late-claim request made within one year may help.
