Why Carlsbad residents and visitors call Green Law Group
You work directly with a lawyer. Steven D. Green, our founding attorney, leads the firm. Our office is in the UTC area near I-5 and La Jolla Village Drive, straight down the freeway from Carlsbad, and we meet clients by phone or video when that is easier.
Before law school, Steven was a manager for several medical device companies and trained surgeons in the operating room. He worked on spinal fusion, disc replacement, microdiscectomy and cardiac laser procedures. That background matters in a Carlsbad case, where a hard fall from an e-bike or a freeway rear-end crash can lead to neck and back surgery. His time in the operating room helps him understand the medical records in cases involving those surgeries.
He graduated cum laude from Loyola University Chicago School of Law with a Health Law certificate, and he is licensed in California and Illinois. Our senior litigation paralegal, Jennifer Kearney, spent more than 15 years at civil defense and plaintiff firms across San Diego County and knows the California Tort Claims Act, which governs claims against cities and transit agencies.
The firm is based in San Diego and takes cases in all 58 California counties. Read more on our San Diego personal injury lawyer page or meet Steven D. Green.

Car crashes on I-5, SR-78 and Carlsbad streets
Carlsbad crashes cluster where freeway and beach traffic meet local roads. I-5 runs the length of the city. SR-78 runs east from I-5 along Carlsbad's northern edge toward Vista and Escondido. Carlsbad Boulevard along the coast mixes drivers with cyclists, walkers and summer crowds.
Whatever the road, the first steps are the same. Get checked by a doctor, keep every bill and receipt, and let your lawyer talk to the other driver's insurer. California law also requires you to report a crash to the DMV within 10 days on form SR-1 when anyone is hurt Veh. Code 16000. If you share some of the blame, you can still recover, minus your share Li v. Yellow Cab Co. (1975) 13 Cal.3d 804.
Our California car accident lawyer page covers the full claim process. For a rough number, try the car accident settlement calculator. If your crash was in the city of San Diego, see our San Diego car accident lawyer page.
Bicycle and e-bike injuries in Carlsbad
Carlsbad has taken bike and e-bike safety seriously for years. The city declared a local emergency over bike and e-bike safety in August 2022. In 2026 it adopted new e-bike laws, including a minimum riding age of 12 and impound rules for minors who ride dangerously.
According to the city, the new laws took effect March 26, 2026, with a 60-day warning period that ended on Memorial Day. They also ban e-bike riding at Poinsettia and Pine Avenue Community Parks and require riders under 18 to wear a helmet. Under state law, no one under 16 may ride a class 3 e-bike, and every class 3 rider needs a helmet Veh. Code 21213.
These rules matter in an injury claim. A rider who broke one may face a comparative fault argument. A driver who cut off a cyclist in a bike lane is still responsible for that choice. The city also notes that e-bikes need no registration, license or insurance. When an e-bike rider injures a pedestrian or another cyclist, finding coverage can take real work, and we look at every policy that could apply.
When the injured rider is a child, a parent usually handles the claim. Read more on our bicycle accident lawyer page and our San Diego bicycle accident lawyer page.
Injuries to visitors: resorts, attractions and beaches
Carlsbad draws visitors to its resorts, theme park, outlet shopping and state beaches. Property owners must use ordinary care to keep their property reasonably safe Civ. Code 1714. If a wet floor, broken stair, poor lighting or a hazard staff knew about caused your injury, you may have a premises liability claim.
Visitor cases have their own problems. You may fly home before you know how badly you are hurt, and the evidence stays in Carlsbad. Before you leave, if you can:
- Ask for a written incident report, and keep a copy or a photo of it.
- Photograph the hazard, your shoes, and the area around it.
- Get names and phone numbers of witnesses and the staff member you spoke with.
- Get medical care locally and keep the discharge papers.
Public property follows different rules. A city, the state or another public entity can be liable for a dangerous condition of its property, such as a broken stairway or parking lot Gov. Code 835. It is generally not liable for injuries caused by a natural condition of unimproved public property, including a beach Gov. Code 831.2. Carlsbad's state beaches, such as South Carlsbad State Beach, are run by California State Parks, so a claim there also faces the six-month government deadline. Our premises liability page explains the law in more detail.
Claims against the City of Carlsbad, NCTD and Caltrans
If a public entity is involved, you usually have only six months to file a written claim Gov. Code 911.2. In Carlsbad that can mean the City of Carlsbad, North County Transit District, which runs the COASTER and BREEZE, Caltrans on I-5 and SR-78, or California State Parks.
Common examples are a crash with a city vehicle, a fall on a damaged city sidewalk, an injury at the Carlsbad Village or Carlsbad Poinsettia COASTER station, or an injury on a BREEZE bus. Each public entity takes claims through its own process, so it matters which one is responsible.
If the entity rejects your claim in writing, you generally have six months from that notice to sue Gov. Code 945.6. Late-claim relief exists but is never guaranteed Gov. Code 946.6. Children get no extra time on the six-month claim CCP 352.

Where a Carlsbad injury case is heard
If your case goes to court, it will usually be filed in San Diego Superior Court, North County Division, at the North County Regional Center, 325 S. Melrose Drive, Vista, CA 92081. The court's ZIP code list assigns every Carlsbad ZIP code to the North County Division for civil cases.
The court decides the branch by where the person or company being sued lives or does business, or where the incident happened. What to do in the first days after a Carlsbad injury
Get medical care first, then protect the evidence. Write down the report number, keep photos, and do not give a recorded statement to the other side's insurer before you talk to a lawyer. Call us any time, day or night, for a free case review.
- See a doctor within a day or two, even if you feel fine. Insurers often point to gaps in treatment.
- Get the report number from Carlsbad Police or CHP, and request the report once it is ready.
- Save the evidence: photos, damaged gear or helmet, clothing, and the names of witnesses.
- File the DMV SR-1 within 10 days if anyone was hurt in a crash.
- Check for a public entity. If a city vehicle, NCTD, Caltrans or a state beach is involved, the six-month claim clock is already running.

Questions
Carlsbad personal injury FAQ
How do I get a Carlsbad Police collision report?
Carlsbad Police Department takes report requests online through GovTransfer. Create an account, choose New Request, select Carlsbad Police Department and the type of report, and watch your email for updates. Its Records Division is at 2560 Orion Way and can be reached at 442-339-2119.
Who handles a crash on I-5 or SR-78 in Carlsbad?
The California Highway Patrol. The CHP Oceanside Area office, at 435 La Tortuga in Vista, patrols Interstate 5 and State Route 78 in North County. Crashes on Carlsbad city streets are usually handled by the Carlsbad Police Department instead.
Which court would hear my Carlsbad injury case?
Usually San Diego Superior Court, North County Division, at the North County Regional Center, 325 S. Melrose Drive in Vista. The court's ZIP code list assigns every Carlsbad ZIP code to the North County Division for civil cases. Most injury claims settle without a trial.
What if a city vehicle, a BREEZE bus or the COASTER was involved?
The City of Carlsbad and North County Transit District are public entities. You usually must file a written government claim within six months of the injury before you can sue (Government Code section 911.2). The same short deadline applies to Caltrans on I-5 and SR-78. Call early so the claim is filed on time.
Can I recover if I was hurt riding an e-bike in Carlsbad?
Often, yes. If a driver, another rider or a property owner was careless, you can bring a claim. California uses comparative fault, so a share of blame on your side reduces your recovery but does not bar it. If the injured rider is a child, a parent usually handles the claim, and a lawyer can explain how the deadlines work for minors.
I was hurt while visiting Carlsbad. Can I still bring a claim after I go home?
Yes. Visitors injured in Carlsbad can bring a claim under California law even if they live in another state. We can work with you by phone, email and video, and we gather the local evidence for you. Contact us before you leave town if you can, so photos, witness names and incident reports are not lost.
How much does a Carlsbad personal injury lawyer cost?
Nothing up front. Green Law Group works on a contingency fee: no fee unless we win, and no costs if we don't. California requires the fee agreement to be in writing and to say the fee is negotiable (Business and Professions Code section 6147). We go over the agreement with you at your free case review.
