Common causes of serious injuries in San Luis Obispo County
The county's biggest injury risks come from long rural highways, a busy US-101 corridor, coastal recreation and agricultural work, each with its own mix of drivers, riders and workers.
- SR-46 from Paso Robles to Cholame. Caltrans and the regional council of governments are widening SR-46 to cut fatal crashes. In 2025 a new interchange replaced the junction with SR-41 near Cholame. See our car accident and truck accident pages.
- US-101 over the Cuesta Grade. The main route links Paso Robles, Atascadero, San Luis Obispo and the Five Cities, carrying commuters, freight and RTA buses.
- Oceano Dunes SVRA. California State Parks runs this off-highway vehicle area on the beach and dunes. ATV, dune buggy and rental injuries can raise premises liability questions.
- Highway 1 along the North Coast. RTA buses run Highway 1 from Morro Bay to Cayucos, Cambria and San Simeon, and drivers there share the road with cyclists and motorcyclists. See bicycle accidents and motorcycle accidents.
- Vineyards and ranches. Harvest work involves tractors, ladders and heat. Read about workplace injuries.
Common injuries after accidents in San Luis Obispo County
Speed on open rural highways, rollovers on the dunes and heavy traffic on the 101 produce most of the serious injuries here. The harder the impact, the more likely the damage reaches the spine or brain.
- Spinal and brain injuries on SR-46. Head-on and broadside crashes at highway speed can cause spinal cord injuries and traumatic brain injury. Families who lose someone may pursue a wrongful death claim.
- Rollover and crush injuries at Oceano Dunes. An ATV or dune buggy that tips on a slope can pin a rider, causing fractures, chest injuries or spine damage.
- Neck and back strain on US-101. Sudden slowdowns on the Cuesta Grade lead to rear-end crashes that commonly cause neck injuries and back injuries.
- Falls and heat illness in vineyards. Harvest ladders and tractors can cause fractures, and long days in summer heat can bring heat exhaustion.
Getting your crash report
Crashes on state highways are reported by the CHP San Luis Obispo or Templeton Area office. Each of the seven cities runs its own police department, and the San Luis Obispo County Sheriff's Office handles unincorporated communities like Nipomo and Los Osos.
Filing deadlines for San Luis Obispo County injury claims
In most injury cases you have two years to sue CCP 335.1. If a public entity is involved, a written claim usually must be filed within six months Gov. Code 911.2. That includes the County of San Luis Obispo, the San Luis Obispo Regional Transit Authority and every city in the county.
The same deadline governs claims against school districts, California State Parks for a dangerous condition at Oceano Dunes, and Caltrans for a highway defect. Once a claim is rejected in writing, the lawsuit is generally due within six months Gov. Code 945.6. Minors do not get extra time on government claims CCP 352. See your dates on the Claim Clock.

Questions
San Luis Obispo County personal injury FAQ
A driver turned in front of my motorcycle on Highway 1 near Cambria. What should I do?
Get medical care first and tell the doctor about every area that hurts, since adrenaline can hide fractures and head injuries. Keep your helmet and riding gear unwashed and unrepaired. Write down where the driver turned, the time of day and any glare or parked cars that blocked the view. Insurers sometimes blame riders, so talk with us before you give a recorded statement.
Can I make a claim for an injury at Oceano Dunes?
Possibly. Oceano Dunes State Vehicular Recreation Area is run by California State Parks, so a claim against the State usually must be presented in writing within six months (Government Code section 911.2). Many dune injuries involve another rider or a rental company instead, which follows the regular two-year deadline. Preserve photos, rental paperwork and witness names.
Is Highway 46 East still dangerous after the Cholame interchange opened?
Caltrans replaced the old SR-46 and SR-41 junction near Cholame with a grade-separated interchange in June 2025 to remove a left turn that contributed to many collisions. Long rural stretches still bring speed, fatigue and passing risks. If you were hurt on SR-46, we look at driver conduct first and road conditions second.
Do I pay anything to talk with you about my case?
No. The first conversation is free and can happen by phone or video at a time that suits you. Ask any injury lawyer how fees and case costs work before you sign. California requires a contingency fee agreement to be in writing and to state that the fee is negotiable (Business and Professions Code section 6147). Green Law Group explains its written fee agreement, including costs, during your free case review.
