Key Takeaways
- Who ran the hospital matters. UC San Diego Health and the Palomar hospitals are public, so a written government claim is usually due within six months.
- Tri-City Medical Center in Oceanside changed hands on July 1, 2026, when Sharp HealthCare took over operations. The date of your care can change the deadline.
- Kaiser members' claims generally go to private arbitration. The VA medical center in La Jolla follows federal rules with a two-year claim deadline.
- A Medical Board complaint can lead to action against a doctor's license, but it cannot pay you anything and does not stop the clock.
- For 2026, non-economic damages are capped at $470,000 in an injury case and $650,000 in a death case. Fees are capped at 25 or 33 percent.
A San Diego malpractice lawyer who has stood in the operating room
Hospital defense teams know how surgery is supposed to go. So does Steven D. Green. Before law school he was a manager for several medical device companies. He worked in the operating room and trained surgeons, doctors and medical specialists to use spine, cardiac and surgical imaging technology. He reviews a San Diego chart with that same eye.
- Trained operating-room teams on percutaneous spinal fusion devices, CO2 cardiac laser systems and SPY intraoperative imaging
- Operating-room experience with microdiscectomy, cervical and lumbar fusion, total disc replacement and laminectomy procedures
- Loyola University Chicago School of Law, cum laude, with a Health Law certificate
- Worked on defective hip implant mass tort litigation before founding the firm
Operative reports, anesthesia records, nursing flow sheets and device logs each tell part of the story. Steven knows what a surgical team is expected to document, and where gaps usually show up. Spotting those gaps early helps us choose the right independent physicians to review your care. Learn more about Steven D. Public or private: San Diego hospitals and the six-month claim
When a public entity provided the care, you usually must present a written claim within six months of the injury before you can sue Gov. Code 911.2. California law counts the University of California's Regents and local districts as public entities Gov. Code 811.2. Several large San Diego County hospitals fall into that group.
| Hospital or system | Who runs it | What it usually means for you |
|---|---|---|
| UC San Diego Health: Jacobs Medical Center (La Jolla), Hillcrest Medical Center, East Campus Medical Center | University of California (the Regents) | Public entity. Six-month government claim first. |
| Palomar Medical Center Escondido and Palomar Medical Center Poway | Palomar UC San Diego Health since July 1, 2026, a joint powers authority of the Palomar Health district and the University of California. The public Palomar Health district ran them before then. | Public agencies. Six-month government claim first. |
| Sharp Tri-City Medical Center, Oceanside | Sharp HealthCare since July 1, 2026. The public Tri-City Healthcare District ran it before then. | Care before July 1, 2026 may need a district claim. Care after that date usually involves a private operator. |
| Sharp Grossmont Hospital, La Mesa | Sharp HealthCare runs it. The Grossmont Healthcare District owns it and leases it to Sharp. | Usually a private operator. We check who employed each provider. |
| Jennifer Moreno VA Medical Center, 3350 La Jolla Village Drive | U.S. Department of Veterans Affairs | Federal claim to the agency within two years 28 U.S.C. 2401(b). |

The building's name does not always tell you who is responsible. A private physician group may staff a public hospital, and a public district may own a hospital that a private system runs. We pull the admission papers, billing records and staff rosters to identify each defendant before any deadline passes.
If a public entity rejects your claim in writing, you generally have six months from that notice to file suit Gov. Code 945.6. Our San Diego personal injury lawyer page explains the government claim process for other local agencies.
Kaiser members and other arbitration agreements
Many San Diego patients signed an arbitration agreement without noticing. Kaiser Permanente members in California generally resolve claims through binding arbitration run by the Office of the Independent Administrator. Other medical groups use similar forms, and California law sets strict rules for how those forms must look.
When a doctor or hospital uses an arbitration agreement, it must carry a bold red notice above the signature line telling you that you are giving up a jury or court trial. You can cancel that kind of agreement in writing within 30 days of signing CCP 1295. Health plan contracts, such as a Kaiser membership agreement, follow separate disclosure rules and are exempt from those two requirements. If you are not sure what you signed at intake, bring the paperwork to your case review and we will read it with you.
Arbitration changes who decides the case and where. Your claim carries over, and the 2026 damage caps and the attorney fee limits apply to arbitration awards too.
Medical Board complaint or civil claim: what each one does
A complaint to the Medical Board of California asks the state to review a doctor's conduct. A civil claim asks for money to cover your losses. The Board says plainly that it cannot provide financial compensation or coordinate your care. You can pursue both, and many patients do.
| Medical Board complaint | Civil malpractice claim | |
|---|---|---|
| Goal | Review the doctor's license and practice | Compensation for medical bills, lost income and pain |
| Who it covers | Medical doctors, licensed midwives and some other licensees | Any negligent health care provider or facility |
| Pays you money | No | Yes, if the claim succeeds |
| Stops your legal deadline | No | Filing on time protects your rights |
You can file a Board complaint online, by mail or by fax. Before you do, tell your lawyer. What you write becomes part of a record, and we want your account to match the medical chart.
Your deadlines in a San Diego malpractice case
Most claims must be filed within three years of the injury or one year after you discovered it, whichever comes first CCP 340.5. The provider must get at least 90 days' notice before you sue CCP 364. Public hospitals add the six-month claim, and the VA uses a two-year federal claim.
- Six months: government claim against UC San Diego Health, the Palomar hospitals or another public entity Gov. Code 911.2.
- One year from discovery: the clock starts when you knew, or reasonably should have known, about the injury.
- 90 days before suit: written notice of intent to sue. Serving it in the last 90 days of the limitations period extends the filing deadline by 90 days from service.
- Three years from injury: the outer limit. Apart from the 90-day notice extension, the statute extends it only for fraud, intentional concealment or a foreign object left in the body.
- Two years: written claim to the federal agency for VA care 28 U.S.C. 2401(b).
Children have longer periods in some cases. Our statewide medical malpractice page covers the minors' rule and the four elements you must prove.
2026 damage caps and attorney fees
AB 35 replaced the old $250,000 limit. For 2026, the cap on non-economic damages is $470,000 in an injury case and $650,000 in a wrongful death case Civ. Code 3333.2. The caps rise each January 1 until 2033, then by 2 percent a year. Medical bills, future care and lost earnings are not capped.
The statute set the starting caps at $350,000 and $500,000, with yearly increases of $40,000 and $50,000. The caps work by category, not per defendant. One cap covers all health care providers together, such as doctors and nurses. A second covers all health care institutions together, such as hospitals and clinics. A third can apply to an unaffiliated provider or institution whose separate act caused separate harm. The amount in effect at the time of judgment, arbitration award or settlement controls.
Fees are capped by law too. A lawyer may take no more than 25 percent of the recovery if the case settles before a lawsuit or arbitration demand is filed, and no more than 33 percent after that Bus. & Prof. Code 6146. If the case goes to trial or arbitration, the lawyer may ask the court or arbitrator to approve a higher fee for good cause. Green Law Group works on a contingency fee: no fee unless we win, and no costs if we don't. If a medical mistake took a family member's life, see our wrongful death attorneys.
Where a San Diego malpractice case is heard
Lawsuits go to San Diego Superior Court. Civil filings are handled at the Hall of Justice, 330 West Broadway downtown, and the North County Regional Center, 325 South Melrose Drive in Vista. The court assigns a location based on where the defendant is or where the injury happened.
An injury from care at Jacobs Medical Center in La Jolla and one from care at Palomar Medical Center Escondido may land in different courthouses. Arbitration cases, such as most Kaiser claims, are heard privately by arbitrators instead of a jury. Either way, most of the work happens on paper and in depositions, and we prepare you for every step.
What to do in the first weeks
Get the care you need first, from a provider you trust. Then request your records, write down dates and names, and keep every bill. California gives patients the right to inspect records within five working days of a request and to get copies within 15 days Health & Saf. Code 123110.
- Request the full chart, including imaging, operative and anesthesia notes, nursing notes and medication logs.
- Write a timeline of symptoms, visits and who said what, while it is fresh.
- Keep paperwork from intake, especially anything about arbitration.
- Avoid posting about your care on social media.
- Call before the six-month mark if a public hospital may be involved.
If the mistake caused a spine problem, our pages on spinal cord injury claims and back injury claims explain those cases. We also handle malpractice claims across all 58 California counties. Questions
San Diego medical malpractice questions, answered
Can I sue UC San Diego Health for medical malpractice?
Yes, but there is an extra step. UC San Diego Health is part of the University of California, and California law treats the Regents of the University of California as a public entity. You usually must present a written government claim within six months of the injury before you can sue (Government Code section 911.2). The 90-day notice rule and the normal malpractice deadlines apply as well.
Is Palomar a public hospital?
Yes. Since July 1, 2026, Palomar Medical Center Escondido and Palomar Medical Center Poway have been run by Palomar UC San Diego Health, a joint powers authority formed by the Palomar Health district and the University of California. The Palomar Health district ran them before that date. Either way the operator is a public agency, so a six-month government claim usually comes first. We confirm the correct entity from your records before anything is filed.
What changed at Tri-City Medical Center in Oceanside?
Sharp HealthCare took over operations of the hospital on July 1, 2026, and renamed it Sharp Tri-City Medical Center. Before that date, the Tri-City Healthcare District, a public healthcare district, owned and ran it. The date of your care can decide which organization is responsible and whether a six-month government claim applies.
Should I file a complaint with the Medical Board of California?
You can, and it may protect other patients. The Medical Board reviews complaints about physicians and can act against a license. It cannot pay you compensation or coordinate your care. A complaint does not extend the deadlines for a civil claim, so talk to a lawyer about both at the same time.
I am a Kaiser member in San Diego. Can I still bring a claim?
Yes. Claims by Kaiser Permanente members in California generally go to binding arbitration run by the Office of the Independent Administrator. Arbitrators decide the case instead of a jury in San Diego Superior Court. California's damage caps and attorney fee limits still apply, so the planning looks much the same. Call early, because the deadlines do not wait.
Where would a San Diego medical malpractice lawsuit be filed?
In San Diego Superior Court. Its civil business offices are at the Hall of Justice, 330 West Broadway downtown, and the North County Regional Center, 325 South Melrose Drive in Vista. The court points cases to a location based on where the defendant lives or does business, or where the injury happened. Many cases settle before trial.
How much does a San Diego medical malpractice lawyer cost?
California caps the fee in a malpractice case at 25 percent of the amount recovered if the case settles before a lawsuit or arbitration demand is filed, and 33 percent after that (Business and Professions Code section 6146). Green Law Group works on a contingency fee: no fee unless we win, and no costs if we don't. The case review is free.
